Step 6 - Property checks

We will double check at this point, that the seller's paperwork is 100% up to date. This means checking the title deeds match details at the land registry office, the property is debt free, and also has an Iskan (habitation certificate).


Some sellers are open to offers in which case, we will convey your offer to them. Otherwise, we inform the agent that you are purchasing and begin the process. We can recommend a list of independent lawyers and translators, or you can source your own. 


Once contracts detailing terms and conditions as well as payment plans have been drawn up and notarized, a deposit to secure the property will be needed, and we will file your military check application.


Step 7 - Pay deposit

The cost of reserving real estate in Turkey is generally around £1,500 and is non-refundable. This amount is given to the seller as a reservation deposit and is deducted from the agreed purchase price. 


However, if the property is reserved, but you decide not to buy it anymore, the reservation deposit is non-refundable.

Step 8 - Appointing Power of Attorney / Hiring a Solicitor 


APPOINTING POWER OF ATTORNEY to conclude the purchase In Turkey there are many different types of power of attorney, there are two that are connected with buying a home in Turkey that you should take note of:


  • General power of attorney: This gives a general right to the solicitor to represent you legally in all matters and in some cases, your signature will be needed for approval.


  • Specific power of attorney: This gives a specific right to a solicitor to represent you in a specific transaction, in this case, a purchase of a property. Specific power of attorney is the normal route that foreigners take when buying a home in the sun.


What can a solicitor in Turkey do for you exactly?


  • The solicitor will help you buy, sell, or rent out your Turkish home.


  • Take care of tax and make legal claims or conduct litigation on your behalf


Before you grant power of attorney to a solicitor, a document will be drafted which will state exactly what the solicitor can and can't do on your behalf. You are free to allow the solicitor as much autonomy or little as you want.


In order to grant power of attorney, you will need to complete certain legal documents that need to be notarised to be used legally in Turkey. These documents will also need to be translated into Turkish and English and notarised. You can also revoke power of attorney at any time. This can be done either in Turkey or in your home country at the local Turkish consulate. All you need to do is to contact a notary or Turkish consulate and send a written notice to your chosen solicitor with the information that the power of attorney has been revoked. Make sure that you request that all copies of the original document are returned to you.


Step 9 - Setting up  a bank account

Step 10 - Receiving the Tapu 


The Tapu is actually or official Title Deed; the proof that you are registered as the official legal owner of a registered property in Turkey.


How do I transfer Tapu?


The Land Registry Office also known as the Baladiyah in Turkey, we will make an appointment for you along with the initial signed property contracts between the seller and the buyer. There is a fee you have to pay for the Tapu in Turkey to transfer ownership, i.e. names. Once you have received your title deeds, you can then begin to register your utility meters to the new names (i.e. new owners) which is usually for the electricity, gas and water meter. This can be all done in person or via appointing power of attorney.


How much is Tapu in Turkey?


The amount of Tapu is 4% of the total property price. Customarily and legally, 2% of the amount is the responsibility of the buyer, and 2% is the responsibility of the seller to pay.


How long does the buying process take?


Buy In Turkey promises a smooth buying process as possible. This usually takes up to 6 to 8 weeks maximum. However, if a client pays the full amount, the process is usually not more than 30 days after contracts signatures.
